Court orders Sahara Reporters to pay N4bn as damages to Senate president, Bukola Saraki

Justice Adeyinka Oyinloye of an Ilorin High Court in Kwara state, has ordered the publisher of online news platform, Sahara Reporters, Omoyele Sowore, to pay the sum of N4 billion as damages to Senate President, Bukola Saraki, over a series of libelous stories published on the news platform from September to December 2015.

Saraki through his lawyer, Babatunde Olomu, approached the court for an intervention following the publication of series of stories against him by Sahara Reporters.

Both Sowore and Sahara Reporters were joined as defendants in the suit marked as KWS/23/2017.

According to Saraki's counsel, the defendants had refused to defend the case despite the service of the summons on them. Olomu said the first series of service involved an arrangement between the office of the Nigerian ministry of Justice and their counterpart in New York, the operational base of the medium.

When that failed, the counsel said the claimant thereafter seized the opportunities of a visit to Nigeria by Sowore to serve him at his two properties in Ikeja area of Lagos state.

The relief granted to Saraki by the court include “the sum of N1 billion as general and aggravated damages for libelous words falsely, maliciously and recklessly published by the defendants of and concerning the claimant in the online issue of Sahara Reporters of October 5, 2015 under the caption “Nigeria at 55: Bukola Saraki and 83 Inmates Are Running the Asylum.

“The sum of N1 billion as general and aggravated damages for libelous words falsely, maliciously and recklessly published by the defendants of and concerning the claimant in the online issue of Sahara Reporters of Sahara Reporters of September 20, 2015 under the caption: “A polished Name for political immorality. Time for Saraki to Go!.

“The sum of N1 billion as general and aggravated damages for libelous words falsely, maliciously and recklessly published by the defendants of and concerning the claimant in the online issue of Sahara Reporters of Sahara Reporters of November 09, 2015 under the caption: “Bukola Saraki On a shopping Spree to Buy Judges…Stop Being a Clown And A Coward Man Up, face The Music”

“The sum of N1 billion as general and aggravated damages for libelous words falsely, maliciously and recklessly published by the defendants of and concerning the claimant in the online issue of Sahara Reporters of Sahara Reporters of December 1, 2015 under the caption: “Arms Contract Scandal: Senator Saraki Blackmailed CBN Officials To Pay N250 Million Hush Funds.”

“An order for injunction restraining the defendants from further writing, printing or causing to be written, printed or circulated or otherwise published of the claimant the said, or similar libel.

“An order directing the defendants to remove the offending publications from its website on the internet within three days from the date of judgment and an order directing the defendants to publish an apology to the claimant on its online newspaper and in three other daily newspapers.”

A 22-year-old woman, who was eight months pregnant, was lured to a home with a false promise of donations for her baby but on getting there, she had her baby cut from her womb after she was hanged and stabbed. Her body was then buried in the back garden by her 27-year-old assailant.

The suspect, Suelen Coimbra do Carmo, said she desperately wanted a child so she lured Costa then carried out the brutal attack on her.

Costa was first drugged, hanged and then stabbed before the baby was cut from her womb. The baby did not survive and was found wrapped in some clothes and dumped in a wash basin inside the suspect's bedroom.

Ironically, Carmo told police that she had an abortion two months ago, despite wanting a child. She met Mrs Costa through social media and began plotting the attack. She was caught after a neighbour she paid to dig the grave for her alerted police. Marcos Pereira was asked by Carmo to dig a hole in her garden, claiming she wanted to plant vegetables but the measurement for the grave caused him to become suspicious.

Carmo has been arrested and charged by police in Goiania, Brazil, south-west of the capital Brasilia. Police spokeswoman Azuen Magda Albarello said Carmo confessed to the crime and told investigators she planned to keep the baby as her own.

She said: "The Civil Police believe that she really wanted a child."

8-year-old boy, Friday Paul, whose paternal uncle tortured and allegedly drove three-inch nail into his skull, has been discharged from hospital against medical advice.

This came after a representative of Lagos Child Protection Network, visited Sagamu Road Police Division, Ikorodu, where the suspect, Mr. Ifeanyi Paul, was being detained. The Divisional Police Officer, DPO, was said to have dismissed the matter, claiming it was mere fiction and that the suspect had no case to answer.

Vanguard learned that the police had discharged the suspect and sent some officers to his abode at 6, Anjolarin Street, Odogunyan, Ikorodu, to warn neighbours and sympathisers to stop divulging information to journalists or risk prosecution.

Mr. Paul’s apartment was under lock and key, an indication that he has relocated from the area. There was palpable fear in the neighbourhood as some residents, who spoke under the condition of anonymity, said the female Investigative Police Officer, IPO, personally visited the area to warn them to stay out of the matter or have themselves to blame.

Also, at Saviour the Rock Hospital, nurses were unwilling to cooperate with Vanguard as they have been warned by the Police to mind their businesses. Doctor Odumabo Adelana referred the reporter to Lagos State Commissioner for Health, Dr. Jide Idris, when he was contacted on phone.

However, a senior Police officer, who pleaded anonymity, said his colleagues may have compromised as the IPO speaks the same dialect with the suspect. He said the suspect and his immediate family have relocated to an unknown place after the victim was discharged outside medical advice.

The source said the IPO and Friday’s senior uncle visited the hospital, weekend, to withdraw all the exhibits from the hospital, after which the boy was discharged against medical advice. According to the source,

“We have enough evidence to prosecute the suspect for child abuse, assault and attempted murder, but our Oga (DPO) and IPO are shielding him for reasons best known to them.

“There are many exhibits relating to the crime: belt, nail, X-ray film, radiological report, GP’s report from General Hospital, Ikorodu, and referral letter showing nail in the head.

“Also, there are pictures of the injury site before and after the surgery and pictures of the previous scars on the face, forehead and legs. But for reasons best known to the DPO, the suspect was discharged and acquitted over the weekend.”

Just when Nigerians thought no lawyer will step out to defend notorious billionaire kidnapper, Chukwudumeme Onwuamadike a.k.a. Evans, Voice Olukoya Ogungbeje has proven an exception.

Ogungbeje, who heads Lawflex Chambers and is the Chairman of Voice Vanguard, grabbed the headlines on Wednesday when he filed a fundamental rights suit on behalf of Evans, dragging the Inspector General of Police, and three others before a Federal High Court in Lagos over Evans alleged illegal detention.

Joined as respondents are the Nigeria Police Force, Commissioner of Police Lagos State, and the Special Anti-Robbery Squad, Lagos State Police Command.

In his fundamental rights, the confessed kidnapper is seeking a court order directing the respondents to immediately charge him to court if there is any case against him.

He is in the alternative, seeking an order, compelling the respondents to immediately release him unconditionally in the absence of any offence warranting a charged.

In the suit marked, FHC/L/CS/1012/2017, Evans is contending that his continued detention by the respondents since June 10, without a charge, or release on bail is an infringement on his fundamental rights.

He argued that the respondents ought to have charged him to court in accordance with the provisions of Sections 35 and 36 of the Constitution.

It was further argued that the alleged offence committed by the applicant (Evans) are correspondingly intertwined with the constitutional safeguards as provided under Sections 35 and 36 of the Constitution.

In a 27-paragraph affidavit in support of the motion deposed to by Evan’s father, Stephen Onwuamadike, it was averred that the applicant has been subjected to media trial without any court’s order by the respondents.

Onwuamadike further averred that the media trial and news orchestrated by the respondents have continued to generate reactions in both print and electronic media without his son being afforded fair hearing before a court of law.

The deponent also averred that since his son’s arrest, all his family members have been denied access to him while media practitioners have been granted unfettered access to him.

The new suit has not been assigned to any judge and no date has been fixed for the hearing.

Controversial cases: Nyako and Ikoyi funds

Evans lawyer, who identified himself on Facebook as Voice Olukoya Ogungbeje had been involved in controversial cases in recent times.

In April, he filed a suit asking the Federal High Court to stay proceedings on the forfeiture of $43,449,947 (about N13bn), N23,218,000 and £27,800 (about N10.6m) found in a flat in Ikoyi, Lagos.

He also sought an order directing the Economic and Financial Crimes Commission to furnish the court with a report of its preliminary or final investigation on the source of the money, its owner, and how the currencies got into the building.

Ogungbeje, in a motion on notice asked the court not to order a permanent forfeiture of the money since there are claims and counter claims as to its ownership by the Rivers State government and the National Intelligence Agency and since the Federal Government had set up the Osinbajo panel to find the truth about the ownership of the money.

“This honourable court has the inherent jurisdiction under Section 6 (6)(b) of the Constitution to order and direct thorough investigation on the sources of the monies, their owners, the owners of the Osborne Towers where the monies were found and how they got into the building.

The case did not get anywhere as the money was later permanently forfeited to the Federal Government.

Ogungbeje also once filed a suit in Lagos in 2014 asking for the reinstatement of Murtala Nyako as governor of Adamawa state. This was after Nyako was impeached by the state assembly in July of the same year and the speaker of the state assembly had taken over.

Again, the case hit the rocks.

Ogungbeje claimed the Assembly’s alleged failure to serve Nyako personally with the impeachment notice violated his fundamental right to fair hearing as enshrined under Section 36 of the 1999 Constitution.

After the court heard arguments from parties and judgment date fixed, Fintiri, through his lawyer, Chief Wole Olanipekun (SAN) urged the judge not to deliver the verdict.

The former Nigerian Bar Association (NBA) president prayed the court to set aside all the proceedings conducted in the suit so far because his clients were not served with the suit in accordance with the law.

According to him, the court should strike out the entire action since the due process of law was not followed.

Olanipekun, who was also representing Mammadi and the House of Assembly, argued that the originating processes were not properly served on his clients.

Notorious kidnapper, Evans, has filed another lawsuit against the Inspector General of Police, Idris Ibrahim, challenging his continuous detention since his arrest on June 10th.The lawsuit was filed through his counsel at the Federal High Court, Lagos.

He is demanding N300 million in damages for his continuous detention without trial and being subjected to media trials.

Joined as respondents in his new lawsuit are the Nigeria Police Force, the Commissioner of Police Lagos State and the Special Anti-Robbery Squad, Lagos State Police Command.

In the fresh lawsuit marked FHC/L/CS/1012/ 2017, Evans is asking the court to declare that his continued detention since June 10th without arraignment, violates his fundamental rights as guaranteed under the 1999 Constitution.

Evans is also asking the court to declare that his parade before the media at the Lagos state police command in Ikeja on June 11th by the police was unconstitutional since the police had no court order to that effect.

The notorious kidnapper is asking the court to order the police to arraign him before a court or set him free. He is also asking the court to order the respondents to jointly and individually, pay him the sum of N300 million as exemplary damages for illegal detention and alleged harm caused by the alleged media trial.

Evan is also seeking an order of perpetual injunction, restraining the respondents from further arresting, detaining, harassing, investigating or inviting him in relation to the facts of his case.

The court is yet to assign a judge to the case nor fix a date for hearing of his new suit.

A woman escaped death by the whiskers on Wednesday, as a car rammed into her shop moments after she closed for the day. The incident happened at Okorie Street off Tetlow Road, Owerri in Imo state. The woman had just locked her shop and was on her way home when the incident happened. There was no casualty recorded fortunately.

Men of the Abia State Police Command have arrested a Fulani herdsman identified as one Adamu Abubakar who shot a commercial motorcyclist popularly known as okada rider. It was gathered that on May 27, at about 2am, the okada rider, one Uyime a resident at Rubber Research Institute of Nigeria, Akwette reported that he conveyed two passengers later identified as Adamu Abubakar and one other now at large from Azumiri to Akwette.

Along the road, the duo attempted to snatch the motor-cycle from him and as he resisted, they shot at him. On May 28, detectives attached to Akwette Division with the help of Vigilante group combed the area and arrested Adamu Abubakar with one cut to size locally made pistol and its live cartridge while the other suspect escaped. The injured victim is receiving treatment in the hospital while effort is intensified toward the arrest of the fleeing suspect.

A pastor in Canada refused to wed a couple after finding out the groom had no immigration papers. According to him, the marriage is not based on love but just for the man to obtain his legal papers to reside in Canada.

The pastor, who is said to be the bride's father, asked the lady while conducting the wedding proceedings if the man had his papers and when she could answer yes,the pastor suspected foul playand pulled out from the wedding proceedings, insisting he wasn't going to be part of the arranged marriage.

A suspected member of the notorious cult group, Badoo, has been apprehended by residents of Ikorodu community in Lagos state. The suspect was caught in Escobar, Ogijo, Ogun State yesterday evening. Ogijo community in Ogun State shares boundary with Ikorodu, Lagos State.

A 48-year-old Nigerian man was savagely pulled out of a train by two ticket inspectors of the Deutsche Bahn German train system because he did not have a ticket. The man had been discovered when the inspectors got to him during a check.

Upon discovery, they asked him to show an ID card and pay a €60 fine but when he couldn't, he was forced out of the train.

A witness captured the inspectors on camera as they engaged in a struggle with the man who vehemently refused to leave the train. The Nigerian fare-dodger held on to metal handrails and refused to let go as two men in uniform struggled to get him out of the train headed to Munich city center from the airport. One of the inspectors can be seen grabbing the man's neck and pulling him towards the door while another tried to remove the man's hand from the rail.

A woman filming the scuffle can be heard screaming at the inspectors and accusing them of racism. She said the guy did not do anything and had given them €9 in cash out of the €60 fine he was asked to pay.

She can be heard saying: “It’s absolutely not OK what you’re doing, the guy didn’t do anything to you. You should be ashamed of yourself, this is racism what you’re doing. Why are you doing this? He paid.”

The woman continues filming until someone seemingly tries to stop her. She later told Huffington Post that the Nigerian man pleaded with the men and told them €9 was all he had and he needed it for food, yet they collected it from him and still threw him out of the train.

When the inspectors finally got the man out on the platform at Leuchtenbergring station, he was forced to the ground with his face pressing against the asphalt. The same woman can be heard yelling at the inspectors again, saying it's “because he’s black.”

Commenting on the incident later, Deutsche Bahn, the company operating trains in Germany, said it was “unusual to receive only partial payments”. The company also stated that the man was acting aggressively and refused to leave the train and that's what led the inspectors to use force. The witness, however, refuted this and described the man as having remained calm.

She shared the video on her Facebook account, adding a caption that suggested he was rough handled because he was black. The post sparked outrage with a lot of people commenting that it had nothing to do with racism and the man was at fault for not paying then refusing to comply with the inspectors.
